Agreement to Our Legal Terms

We are WeatherRoast (“Company”, “we”, “us”, or “our”). We operate the WeatherRoast mobile application (the “App”) and related services that reference these Terms (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Our Services

WeatherRoast provides humorous, voice-enabled weather forecasts. Information is for general information and entertainment only and may be inaccurate, delayed, or unavailable. Always follow official guidance. Access from other jurisdictions is at your initiative; you are responsible for local compliance.

2. Intellectual Property Rights

We (or our licensors) own all intellectual property rights in the Services, including software, text, audio, graphics, images, and marks. Subject to these Terms, we grant you a personal, non-exclusive, revocable licence to use the App for non-commercial purposes. Except as permitted by law, you may not copy, distribute, reverse-engineer, or exploit the Services without prior written permission.

3. User Representations

By using the Services, you represent that you are 18+, have legal capacity, will use the Services only for lawful purposes, will not use automated tools (bots/scripts) to access them, and will comply with all applicable laws.

4. Purchases and Payment

Payments are processed through Google Play billing. You agree to provide accurate and up-to-date payment information. Prices may vary by region and may include applicable taxes. We may correct pricing errors or decline transactions suspected of fraud or abuse.

5. Subscriptions

Billing and renewal. If you upgrade to a WeatherRoast subscription, payment processing is handled entirely by Google Play. WeatherRoast does not collect or store your payment card or billing details. All billing, renewals, and refunds are managed through your Google Play account settings.

Cancellation. You may cancel at any time in your Google Play account; cancellation takes effect at the end of the current paid term.

Fee changes. We may change subscription fees with notice in accordance with applicable law.

6. Refunds Policy

All sales are final. Refund requests should be made through Google Play under its refund policy. If you experience technical or billing issues, contact hello@weatherroast.app.

7. Software Licence

You may install and use the App on devices you own or control. You may not reverse-engineer, decompile, or modify the software except where permitted by law. Store versions are also governed by the relevant store’s terms. The App is provided “as is.”

8. Prohibited Activities

You agree not to misuse or disrupt the Services; attempt to gain unauthorised access; upload malware or spam; scrape or republish content; impersonate others; harass or abuse; or otherwise use the Services in violation of law or these Terms.

9. Advertisements

The free tier may display banner/interstitial advertisements. We provide ad space and do not control advertiser content or offerings. Ads are delivered by third-party partners (e.g., Google AdMob) in accordance with your device and regional settings.

10. Third-Party Websites and Content

The Services may link to third-party sites or display third-party content. We do not control or endorse, and are not responsible for, third-party sites or content. Your use of third-party sites is at your own risk and subject to their terms and policies.

11. Privacy Policy

By using the Services, you agree to it.

12. Term and Termination

These Terms remain in effect while you use the Services. We may suspend or terminate access for breach of these Terms or other lawful reasons. You may stop using the Services at any time by uninstalling the App or cancelling your subscription. Sections that by nature should survive termination (e.g., IP, Disclaimer, Liability) remain in effect.

13. Modifications and Interruptions

We may change, modify, suspend, or discontinue any part of the Services at any time without prior notice. We do not guarantee the Services will always be available or uninterrupted and are not liable for any downtime, unavailability, or loss resulting from maintenance, updates, or changes.

Service Closure. If WeatherRoast is discontinued, permanently removed from an app store, or otherwise shut down, access to the Services may end immediately or at the end of your current billing period. In such cases, no further subscription renewals will be charged, and no additional compensation or refunds will be provided beyond what is required by Google Play’s refund policy.

14. Governing Law

These Terms are governed by the laws of England and Wales. If you are an EU consumer, you also benefit from any mandatory consumer protections of your country of residence. The parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

15. Dispute Resolution

Informal resolution. Before starting formal proceedings, the parties will try in good faith to resolve any dispute for 30 days after written notice.

Arbitration (optional alternative). If not resolved, disputes may be finally settled by binding arbitration in England and Wales, in English, under the Arbitration Act 1996 by a single arbitrator appointed by agreement (or by an appropriate appointing body if not agreed). Arbitration is individual only (no class/representative actions) to the fullest extent permitted by law. This clause does not prevent either party from seeking injunctive relief or protecting intellectual property in court.

16. Corrections

Information in the Services may contain errors or omissions (including descriptions, pricing, and availability). We may correct or update information at any time without notice.

17. Disclaimer

THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant accuracy, availability, or that the Services will be error-free, secure, or uninterrupted. You use the Services at your own risk.

18. Limitations of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WEATHERROAST AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, REVENUE, OR DATA) ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
IN ANY EVENT, OUR TOTAL LIABILITY TO YOU WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations; where so, the above limits apply only to the maximum extent permitted by law.

19. Indemnification

You agree to defend, indemnify, and hold harmless WeatherRoast and its officers, employees, partners, and agents from any claim, loss, or demand (including reasonable legal fees) arising out of your use of the Services, your breach of these Terms, your violation of law, or your violation of third-party rights.

20. Electronic Communications, Transactions, and Signatures

By using the Services, you consent to receive communications electronically and agree that electronic agreements, notices, and records satisfy any legal requirements that such communications be in writing. You consent to electronic signatures and records.

21. California Users and Residents

If any complaint with us is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, USA, or (800) 952-5210.

22. Miscellaneous

These Terms and any referenced policies (including the Privacy Policy) constitute the entire agreement between you and WeatherRoast. If any provision is held invalid, the remainder remains enforceable. No waiver is a continuing waiver. We may assign our rights and obligations to a successor or affiliate.
